1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Rohit Kumar, operating under the brand name Host Wallah ("Hostwallah", "we", "us", or "our"). By accessing or using the Hostwallah platform, you agree to be bound by these Terms. If you disagree with any part, you may not access the service.

2. Description of Service

Hostwallah provides high-performance web hosting infrastructure, VPS (Virtual Private Servers), domain registration, and reseller WHM accounts. Features include cPanel control panels, automated staging environments, DNS management tools, SSL provisioning, automated daily backups, and traffic analytics.

3. Eligibility & Registration

• ✓You must be at least 18 years of age and have the legal authority to enter into contracts
• ✓You must provide accurate, complete, and current account information
• ✓You are responsible for maintaining the confidentiality of your credentials
• ✓You are responsible for all activities under your account
• ✓One person or entity may not maintain more than one free account

4. Domain & Legal Compliance

By using Hostwallah, you agree to comply with:

Strict WarningYou may not use Hostwallah servers to host malware, run phishing sites, or distribute spam/unsolicited commercial emails. Violations will result in immediate termination of all active server instances without refund.

• Subscriptions are billed monthly or annually in advance
• Hosting resource overages (bandwidth/storage) are billed at published tier rates
• All fees are non-refundable except as required by applicable law
• We reserve the right to change pricing with 30 days' notice
• Failed payments may result in service suspension after 7 days

7. Intellectual Property

The Hostwallah platform, including its UI, code, brand, and documentation, is owned by Hostwallah and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the platform for your business purposes.

8. Data Processing

For enterprise customers, we will enter into a separate Data Processing Agreement (DPA) that governs how we process personal data on your behalf in accordance with applicable data protection laws (including GDPR and India's DPDP Act 2023). Contact legal@hostwallah.com to request a DPA.

We target 99.9% monthly uptime for paid plans. Scheduled maintenance will be communicated 48 hours in advance. Downtime caused by network backbone or upstream cloud infrastructure partners is excluded from SLA calculations.

11. Termination

Either party may terminate the agreement with 30 days' written notice. We may terminate immediately if you violate these Terms, engage in fraudulent activity, or fail to pay amounts due. Upon termination, your access will be revoked and data deleted per our retention policy.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra. For disputes under ₹1,00,000, we encourage resolution through mediation before litigation.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you via website or in-app notification at least 15 days before material changes take effect. Continued use after such period constitutes acceptance.
